Organizational performance is influenced by a number ofseveral factors. One key factor is nth management of the human resource and various resources in an organization such as financial management. It is a result that various schools have delved into finding out what organizational theories can be used to foster the performance of an organization. It is important to note that One such theory that is popular in the discussion is the classical organization theory. This paper seeks to discuss the classical organization theory with respect to the contributions of various scholars and the implications of the same in decision-making.

 

Background of the issue

The development of the classical organizationtheory has been day in and out. Manyresearchesresearch and studies have been made in attempt to improve the viability, effectivenesseffectiveness, and reliability of the theory. It is important to embrace all the contributions of the various scholarsand how the same could be embraced in decision making, human resource managementmanagement, among others.

Public administration is different from private administration in the sense that public administration entails offering services in management in public organizations and entities such as the state-owned. On the other hand, private management entails services that are offered in the sector in private entities such as privately-owned organizations. There is usually a greater sense of responsibility in private management as compared to public administration (Sroufe, 2017).

In the public administration, there is usually adherence to government formulated policies in the management of the public-ownedpublic owned as compared to the private management where the owners formulate the management policies and guidelines through the use ofusing the managers that are often delegated the duty of doing such. The taxpayers for instance fund the public entities as opposed to the private organizations that are often funded by the owners or through the trading of shares in the listed companies (Oreg& Berson, 2019).

It is vital to note that the differences in the above influence a number ofseveral aspects in an organization that have to do with decision making, human resource management, and the classical organizational theory. For instance, decision-making is through the management that is employed by the government. The input of the public could also be need when it comes to decisions that are made in public administration. There is also a strict adherence to a given stipulated public administration code of performance and administration amongst the state officers. It is in sharp contrast to the private management that mostly does the contrary to the above.

Regarding human resource management, as mentioned above, the human resource is managed according to the stipulated operational policies and laws of the government in most cases. For instance, the grounds for dismissal and hiring are usually as guided by the government or public stipulation which is often not the same as the private management. It is the reason for a more stringent management oof human resources and more accountability of human resources as compared to private management.

On the other hand, the classical organizational theory is influenced greatly by the type and differences rights are encountered as discussed above. For instance, the administration of the affairs of organizations is directly linked to public accountability and government directives as opposed to private management where accountability is to the owners and maybe to the shareholders (Aslam et al., 2018).

Additionally, aspects such as money management and use also have a direct link to the various policies and guidelines that govern the two types of management and practices that are linked to the same. It is important to note that in many countries or nations, both private management and public administration have been of great sense and hence it has evoked the need for even better management of the same. It explains the need for the input of the various scholars into making the field of organizational management even better through the use ofusing the various study recommendations and inputs by numerous scholars such as the ones that are discussed in this paper.

Recommendations

It isimportant to adhere to the various scholarlyadvocaciessuch as sticking to classical theory advisories on how for instance to increase the effectiveness and the efficiency of the managementthrough better human resource management. Additionally, the difference between the private and publicmanagement and amidnsuitarion should be clearlyevaluated to ensure the bestpractices are sued and discard the unnecessary practices such as pooraccountability.

    a. Summary of Case

    Gideon vs. wainwright remains to be one of the most infamous supreme court cases in Judicia history. This Supreme Court case declared that defendants charged with a felony must be provided with a court-appointed attorney by the States. Initially, the Litigation was known as Gideon v. Cochran, but when it reached the Supreme Court, the title changed to Gideon vs. wainwright (Oyez, 2018). This happened due to the replacement of the director of Florida’s Division of Corrections from Cochran to Louie Lee Wainwright.

    The case commenced when Clarence Earl Gideon was in 1961 charged with a felony for purportedly burgling a Pool Hall in Panama City, FL, and stole some money. Gideon was a poor man, and during his first trial, he requested the Court to appoint an attorney who would represent him. Gideons requests were refuted despite not having the capacity to select a lawyer for himself. The prosecutors had witnesses who had seen Gideon at the crime scene. However, he had not been seen committing the crime (Oyez, 2018). The court ruling sentenced Gideon to five years imprisonment despite the lack of concrete evidence. Gideon considered the detention as unjust and filed a petition to the Florida Supreme court. His claims in the petition were that he did not have an attorney general to defend him during the trial, which made it unconstitutional.

    Gideon’s petition for a writ of habeas corpus from the Supreme Court of Florida was accepted. The judicial system had denied Gideon his 6th amendment rights. In 1963, the case was reassessed, and the Supreme Court ruled out that the judgment that had earlier been made to Gideon was unconstitutional (Greenberg & Page, 2018). The Court ruled that all defendants need to have the assistance of Counsel in their defense, and Gideon was thus set free.

    b. Case Outline

    1. Title: Gideon vs. wainwright (1963)

    2. Facts of the Case

    Clarence Earl Gideon was an eighth-grade dropout who had run away from home when he was in the middle class. He was a drifter who spent most of his time in and out of prison. He was charged with a lawful offense of breaking into a Pool room in Florida (Oyez, 2018). He appeared in Court without legal Counsel and requested the Court to appoint one for him. His request was denied. Back then, a lawyer would only be given to an indigent offender in capital cases. The defendant was forced to represent himself in Court, where he was found guilty and sentenced to five years in prison (Oyez, 2018). Clarence Earl Gideon appealed his case again to the Supreme Court of the United States. The case was reviewed and resolved.

    3. History of the case

    Clarence Earl Gideon was found guilty and was sentenced to five years in prison (Oyez, 2018).

    4. Legal Questions

    The Court needed to determine whether Clarence Earl Gideon was guilty or innocent. If found guilty, the Court would decide the number of years that Gideon required to be imprisoned. The Supreme Court of the United States had an excellent task of determining whether Gideon’s conviction was unconstitutional or constitutional. Also, the Supreme Court had to determine whether a poor accused defendant should be given Legal Counsel to represent them in Court.

    5. Decision or Holdings

    The Supreme Court serves justice to the defendant by making the final decision. In Gideon’s case, the Supreme Court served justice after being abused by the judicial system and denied his 6th amendment rights (Rappaport, 2017). The judicial system in Florida had not done an adequate job in upholding the law, which put the American man at considerable risk. From the Supreme Court ruling, every poor person who cannot afford a legal representative should be allocated one by the Court.

    6. Verdict and Opinion

    The Supreme Court heard the oral arguments for Gideon vs. wainwright on January 15, 1963. Abe Fortas, the attorney of Gideon, provided that no defendant, regardless of their competence level, could or should give good self-representation before the court (Greenberg & Page, 2018). After two months, on March 18, 1938, Fortas’ claim was accepted by the Supreme Court. The Supreme Court declared that state courts must guarantee the right to counsel.

    c. Conclusion

    Gideon was convicted of committing a lawful burglary at the Bay Harbor Pool Room in Panama City, Florida. He was a semi-literate drifter who could not afford a lawyer at his trial in the state court. He asked the judge to appoint a legal counsel for him, but his request was declined. The judge asserted that the state did not have to pay a lawyer for a poor defendant that did not commit a capital crime. Gideon was left to represent himself, where he was found guilty and sentenced to five years imprisonment. Gideon acquired a legal representative who argued that the judgment had been unconstitutional since Gideon’s 6th amendment rights had been violated by appealing to the Supreme Court. The clear remains prominent in criminal justice history as it made it clear that for all individuals who cannot afford a lawyer, the Court should appoint legal counsel to defend them in the case. This should be done in all cases and not only the serious ones. The case showed that the rights of all human beings should be respected and protected regardless of their position in society.

Avoid undercover or other surreptitious methods of gathering information unless traditional, open methods will not yield information vital to the public– Society of Professional Journalists Code of Ethics, 2014.

So often media outlets publish stories based on administration sourcesaides, or some other jargon describing insiders who were somehow talked to the press on condition of anonymity.

By not properly identifying sources, media organizations are less credible in their capacity to shape policy through mutually informing the public of government positions, and informing civic officials of public opinion (Graber & Dunaway, 2015).

Recognize a special obligation to serve as watchdogs over public affairs and government. Seek to ensure that the public’s business is conducted in the open, and that public records are open to all. I think the reporters that cover the federal government do an excellent job in promoting transparency. Through aggressive questioning dutiful journalists publish up-to-the-minute reports on hot topics and scandals.

Through transparent reporting and covering issues of the day, media organizations are fully able to execute their role by informing the public of government positions, and allowing public officials platforms from which to discuss their positions (Graber & Dunaway, 2015).

Distinguishing advocacy from commentary is continuously blurred on cable news. Depending on the network, the bias is clear. In some cases, the host will allow one guest to finish an argument while silencing the other if the second individual does not agree with the host’s thoughts on an issue.

By disguising opinion as news, journalists and their media organization employers deceive the public regarding the nature of government positions. The news outlets can also mask or distort issues the public deems important in favor of political ideology (Graber & Dunaway, 2015).
