What are the legal implications? How would you evaluate the effectiveness of your approach?

Employee #1

Jimmy Brown is a manager with Solomon Industries, Inc., (SII) a supply company in South Carolina. SII serves as a warehouse for other companies that deliver and store their goods using SII’s facility as temporary storage.   Jimmy was born in 1955 and spent 20 years in the military. Upon retiring, he was hired as a production supervisor for SII.  Originally from SC, he is the night shift supervisor working 12 hour shifts from 7:00 pm to 7:00 am Monday through Thursday supervising 12 employees.  Jimmy is a traditional Baby Boomer as he grew up in the 60’s, his dad worked, his mom stayed home, and he is the oldest of three children; a brother and a sister 2 and 4 years younger, respectively.  Jimmy received his bachelor of arts degree while in the military in chemical engineering.  Turnover is pretty high at SII as Jimmy is constantly training new employees. He had the option of moving to the day shift but he worked nights his whole military career and likes this shift so he asked to continue working this shift.   His present staff consists of 1 employee over the age of 50 and the rest of the employees range from 20-40 years of age.

Employee #2

Michael Johnson was born in 1976 in Ohio.  He has a technical background graduating in 1997 in computer science and moved to SC in 2010 with his new bride.   Michael’s parents divorced when he was 2 years old and he rarely saw his biological father. His mom worked two jobs almost 7 days a week until she remarried when he was 10. His step dad travelled often with his job and had two daughters from a previous marriage.  Their mom died 3 years before he married Michael’s mom.    Michael applied for the Information Technology position but at the last minute the position was closed because the employee decided not to leave the company so Michel took on the responsibility of being the day shift supervisor.  He works 7:00 am to 7:00 pm Monday through Thursday with Solomon Industries, Inc., (SII) a supply company in South Carolina. SII serves as a warehouse for other companies that deliver and store their goods using SII’s facility as temporary storage.  Turnover is not as high as his night shift counterpart, but still has some turnover.   The company allows tenured employees to move to the shift they desire if positions are available.  Michael manages 15 employees, 8 are over the age of 50, 2 are new employees under 21 years old, and the remaining are between 21-50 years of age.

    • How would you evaluate the effectiveness of your approach?

3, A few recent studies have linked the presence of the artificial sweetener, subsutural, to cancer in laboratory rats. While the validity of these findings has been hotly debated by medical experts, the Food and Drug Administration has ordered products containing the ingredient banned from sale in the U.S. The Jones Company sends all of its sugar-free J.C.Cola (which contains subsutural) to European supermarkets because the sweetener has not been banned there. Is it acceptable for the Jones Company to send an arguably unsafe product to another market without waiting for further evidence?

4, The Acme Company sells industrial supplies through its own sales force, which calls on company purchasing agents. Acme has found that providing the purchasing agent with small gifts helps cement cordial relationships and creates goodwill. Acme follows the policy that the bigger the order, the bigger the gift to the purchasing agent. The gifts range from a pair of tickets to a sporting event to outboard motors and snowmobiles. Acme does not give gifts to the personnel at the companies which they know to have an explicit policy prohibiting the acceptance of such gifts. Assuming no laws are violated, is Acme’s policy of providing gifts to purchasing agents morally proper?

5, The Buy American Electronics Company has been selling its highly rated System X Color TV sets (21″, 19″, 12″) for $700, $500, $300 respectively. These prices had been relatively uncompetitive in the market. After some study, Buy American substitutes several cheaper components (which engineering says nay reduce the quality of performance slightly) and passes on the savings that consumer has in the form of a $100 price reduction on each model. Buy American institutes a price-oriented promotional campaign which neglects to mention that the second generation System X sets are different from the first. Is the company’s competitive strategy ethical?

6, The Smith and Smith Advertising Agency has been struggling financially. Mr. Smith is approached by the representative of a small South American country which is on good terms with the U.S. Department of State. He wants S and S to create a multimillion dollar advertising and public relations campaign which will booster the image of the country and increase the likelihood that it will receive U.S. foreign aid assistance and attract investment capital. Smith knows the country is a dictatorship which has been accused of numerous human rights violations. Is it ethical for the Smith and Smith Agency to undertake the proposed campaign?

Bandura identified the four influences of self-efficacy as enactive attainments, vicarious experience, verbal persuasion, and physiological state. The two that I decided to pick for this week’s topic are verbal persuasion and enactive attainments. First, I think it is essential to understand the definition of self-efficacy. “Self-efficacy beliefs are estimates that people make about their ability to perform specific actions. Self-efficacy refers to the self-assessment of one’s ability to perform specific tasks in specific situations” (Martinez 2010, pp 174).

Verbal Persuasion

Martinez describes verbal persuasion as illustrating the power of teachers to influence the course of students’ lives. Verbal persuasion can be as simple as telling a student you believe in them, and they are going to do excellent on the test or assignment. Verbal persuasion can sometimes be harmful to students’ self-efficacy. A discouraging or negative remark to a student from a teacher, parent, or even a peer can have unwanted lasting effects on a student. The negative comment can discourage the student to doubts their capability of achieving success. When a teacher uses verbal persuasion, they should use specific feedback and encouragement to increase the student’s self-efficacy. For example, suppose a student has struggled with confidence with their math skills. In that case, a teacher may walk by and comment that students’ problem-solving skills are improving because they are mastering the order of operation. Giving specific feedback encourages the student to continue growing because it is not going unnoticed.

Enactive attainments

Enactive attainments are the other influence that I decided to talk about this week. “Past failure or success influences one’s likelihood to believe that one will succeed or fail at a given task. It is important to note that performance alone is insufficient because learners cognitively evaluate success in response to the aid they received, the unique circumstances, and their evaluation of success and failure patterns. Failures can undermine efficacious beliefs unless the educator handles them correctly” (Shooter, n.d)

Critical Thinking Vs. Problem Solving

As we learned more in-depth last week how critical thinking and problem-solving do have some similarities, they are also different. One was problem-solving is different than critical thinking is that there is no infinitive way to problem solve correctly. It would be best if you went through all possible trial and error to find the correct solution. When talking about critical thinking, one must do it internally to help come to have a more in-depth thought process about the topic.
