At present the ideology in terms of punishment in American society at least is retributive. This stemmed from a mid-20th-century debate between the merits of rehabilitation and a form of fixed sentences that was uniform (and therefore fair) and applied to everybody. The Sentencing Reform Act of 1984 and subsequent political acts took care of that and has been adhered to the present day. The philosophy behind this legislation is that rehabilitation is not effective for all individuals and therefore society needs to be protected from individuals who do wrong (against others or property) with the best way of doing that perceived as being incarceration or incapacitation (Zimring).

One of the main issues in determining ethical ways of dealing with wrongdoers is that there needs to be an established set of roles and definitions that work within society to provide a system that all potential criminals are subject to. Rawls for example noted that defining punishment was not the same as justifying punishment. Justifying the use of prisons should be separate from any act of punishment (committing a person to such place). and that the practice of punishment must be justified through either forward-thinking (consequentiality), or backward thinking (deontological).

Based on his (and others) ideas it is generally agreed now that while the act of punishment might be the cause of some debate in terms of harshness and appropriateness, the justification for punishment is assumed. Secondly, that the justification for punishment comes from both consequential and deontological considerations.There are a number of reasons why punishment needs to be justified. Firstly punishment is a man-made action – it is not a natural fact and does not exist outside of the human experience.

Therefore the rules that govern such action (humans on humans) are ones that should be considered ideal within society. Punishment as such is something that we as a human society decide to have and maintain within our society – it is a choice and as such could be done without.

The present research has identified that if only black males of college age are considered then much fewer are in prison rather than in school. Also, the number of black males telecommuting, taking classes online, cannot be quantified. This is why some studies show slightly more black males in prison than in college. Still, this clarification does not lessen the astonishing realization that something is very wrong about a society where such a disproportion exists in its criminal justice and educational systems.

Realizing this unfortunate reality of our society is the objective of the question. The answer begs the question of why. A one-word reaction might be racism. Institutional racism, Jim Crow laws of the South, for example, has been outlawed for more than half a century but, rather ironically, racism within the nation’s justice system continues and is the root cause for as many black men being in prison as in college. Anyone who has turned into to watch the documentary of a prison, even for just a few minutes becomes instantly aware that black males are disproportionately represented within the prison population.

Black males comprise approximately 6.5 percent of the general population yet one-third of the prison population, more than any other ethnic group. When classified according to ethnicity, a broad disparity within the justice system is obvious. “At midyear 2003 there were 4,834 black male prisoners per 100,000 black males in the United States in prison or jail, compared to 1,778 Hispanic male inmates per 100,000 Hispanic males and 681 white male inmates per 100,000 white males”. This overrepresentation of black males in prison is the opposite of that within institutions of higher learning.

Of all ethnic groups, black males experience the lowest graduation rate.

No matter how thoughtful and well planned the design is, one cannot hope to completely eradicate aggression in the setting of a bar or pub.

On the other hand, one cannot simply ignore the “influence” of the design of a pub or bar on the “mood and behavior of people who spend time in it” (Conflict & Violence in Pubs: Design Issues, 1992 p.3). This is because various elements in the environment in which humans function are known to exercise a high level of influence on their behavior and determine how they respond to given situations. The design, light, color or flow patterns of bars and pubs, when coupled with other factors such as drunkenness and noise pollution, can increase the stress levels of patrons and create flashpoints for instigating aggression.

Research evidence suggests that the design, interior and “overly energetic décor – complexity and color schemes” are causing “between 15 and 20% of all aggression” in bars and pubs (Conflict & Violence in Pubs: Design Issues, 1992 p.3). Therefore, these factors need to be taken into consideration when the designs of bars and pubs are planned and decided. Thus, apart from an appropriate shape and direction of the building and suitable design, it is significant to choose a sober color scheme to facilitate a more congenial setting in pubs to reduce the stress levels of drunken customers and to encourage them to conduct peacefully.

In the present day, “client-initiated violence” is on the increase, which is identified as a major issue in “retail trade” including bars and pubs.
